Reasonable evidence of condition may be requested. This rule does not remove rights where goods are defective, damaged or incorrect.

5. Direct return cost

For an ordinary change-of-mind withdrawal, the consumer bears the direct cost of returning the goods unless we agree to bear it or mandatory law requires otherwise. No restocking or handling fee is charged merely for exercising the statutory withdrawal right. We bear the appropriate costs for a confirmed lack of conformity, incorrect item or damage for which the seller is responsible.

6. Reimbursement after withdrawal

For a valid withdrawal, we reimburse payments received for the withdrawn goods and the cost of the least expensive standard delivery offered for that order. Extra cost arising from a customer’s choice of a more expensive delivery method is not reimbursed where the law permits.

Reimbursement is made without undue delay and no later than 14 days after being informed of the withdrawal. We may withhold reimbursement until the goods are received or the consumer supplies evidence of having sent them, whichever occurs first. The original payment method is used unless another method is expressly and lawfully agreed, and no refund fee is charged by us.

7. Statutory exceptions

The withdrawal right does not apply where a statutory exception under the Italian Consumer Code applies. For physical T-shirts, an exception could be relevant only in specific circumstances, such as goods made to the consumer’s specifications or clearly personalized. An exception will not be asserted for a standard product merely because packaging was opened or the item was inspected normally.

8. Incorrect, damaged or missing goods

Contact us promptly with the order number and clear photographs where relevant. Do not discard the item or packaging before reasonable evidence can be collected. We will assess the appropriate correction, replacement, price reduction, termination or refund under the Italian Consumer Code. A carrier claim process does not replace the seller’s mandatory responsibility to the consumer.

9. Italian legal guarantee of conformity

The seller is responsible for a lack of conformity existing when goods are delivered and becoming apparent within the statutory period. For new consumer goods in Italy, the legal guarantee generally covers two years from delivery. A T-shirt may lack conformity if, considering the contract and applicable legal criteria, it does not match the description, type, quantity, quality or agreed characteristics, is not fit for ordinary or specifically accepted purposes, or does not possess qualities the consumer may reasonably expect.

The consumer may request repair or replacement without charge, subject to the legal rules on impossibility and disproportionate cost. Where bringing the goods into conformity is refused, impossible, late, causes significant inconvenience, fails, or the lack of conformity is sufficiently serious, the consumer may be entitled to an appropriate price reduction or termination and reimbursement. A minor lack of conformity may not justify termination. These rights are separate from the 14-day withdrawal right and any voluntary commercial return arrangement.

10. Exchanges

An exchange for a different size, colour or product is not guaranteed unless agreed and stock is available. A consumer may use the statutory withdrawal process for an eligible item and place a separate order. A replacement required as a conformity remedy is handled under the legal guarantee and is not treated as a voluntary exchange.

11. Refused or uncollected parcels

Refusing or failing to collect a parcel does not by itself constitute a clear withdrawal notice. Contact us expressly. If a parcel is returned because of an incorrect address, non-collection or refusal without a valid legal basis, reasonable direct costs may be taken into account only where disclosed and permitted by law.

12. Complaints and ADR

Send a written complaint to support@rwhsyah.com describing the order, facts and requested solution. If the dispute remains unresolved, an eligible consumer may consider an Italian alternative dispute resolution body listed by the competent authority. The former EU Online Dispute Resolution platform was discontinued and is not presented as an available complaint channel.
